How Tax Delinquent Property Sales Work in New York

Outside of New York City, New York enforces delinquent property taxes by in-rem judicial foreclosure under Real Property Tax Law Article 11. Rather than selling a lien, the taxing district takes title to the property by court judgment and then resells it at a public, often online, auction. The buyer at that county auction receives a deed with no further owner redemption. New York City is the exception: it bundles delinquent tax liens and sells them in bulk to a single authorized purchaser who collects the debt plus interest — a negotiated transaction not open to retail investors. Following Tyler v. Hennepin (2023), New York counties must attempt to return surplus proceeds to the former owner. Investors should not treat New York as a tax-lien-certificate state; statewide it is deed-by-foreclosure.

At the county resale auction, bidding is premium bid-up — the property goes to the highest bidder.
